DarkBlue SEO CHALLENGE

  1. There are two separate competitions, the SEO Player Competition and the SEO Stayer Competition ("the Competitions"). The Competitions both commence on 7th May, 2004.

  2. The joint promoters of the Competitions are DarkBlue.com Pty Ltd and the owners/operators of SearchGuild.com ("the Promoters").

  3. Entry is open to current members of the SearchGuild.com forum, except those members who are also employees of the Promoters or members of the employees immediate families ("Entrants"). The relevant webpage(s) of the Promoters will block Googles' robots until the end of the Competitions to avoid the indexing of the Promoter's webpage(s).

  4. To be eligible to enter, the Entrant's website must display the DarkBlue.com/SearchGuild.com competition logo with the Entrant's SearchGuild.com forum username displayed directly underneath. The competition logo and the Entrants forum username and must be displayed on the Entrant's website as at the time the winner of the relevant competition is determined.

  5. Entrants must comply with Google’s Guidelines for Webmasters. We do not condone the use of practices that do not comply with these guidelines. Entrants who do not follow these guidelines risk having the website and/or it’s author banned by Google. Such practices may also be in breach of the Competition Terms and Conditions and may render the website ineligible to enter. We highly recommends the use of best practice standards for search engine optimization. In addition many of these guidelines can be found at the World Wide Web Consortium (w3.org).

  6. The Entrants website shall not contain material or content (or links to such material or content, including but not limited to banner advertisements or pop-ups) that:

    a. Contains nudity, vulgar or obscene language or is otherwise of a sexual or pornographic nature;
    b. Is hateful, derogatory or bigoted based on racial, ethnic, political or sexual grounds;
    c. Is defamatory or invades another person's privacy or property rights or is otherwise illegal.
    d. Depicts minors engaged in any activity of a sexual nature or may otherwise harm minors.
    e. Infringes the trademark rights, copyright or other intellectual property rights of third parties.
    f. Violates any applicable local, state, national or international law or regulation.
    g. Promotes, is involved in or assists in, the conduct of illegal activity of any kind or promote business opportunities or investments which are not permitted under law.
    h. Advertises or offers for sale any goods or services that are unlawful or in breach of any national or international law or regulation.
    i. Advertise or offer for sale any goods or services the Advertiser does not have the legal right to sell.


  7. The winner of the SEO Player Competition shall be the entrant whose website is the number one (1) ranked search result for the SEO Challenge search term on http://www.google.com at 9am GMT on 7th June, 2004. In the event that the website with the number one (1) ranked search result at the relevant time is not a website owned or controlled by an Entrant, then the winner shall be the Entrant with the highest ranked page for the search term at the relevant time.

  8. The winner of the SEO Stayer Competition shall be the entrant whose website is the number one (1) ranked search result for the SEO Challenge search term on http://www.google.com at 9am GMT on 7th July, 2004. In the event that the website with the number one (1) ranked search result at the relevant time is not a website owned or controlled by an Entrant, then the winner shall be the Entrant with the highest ranked page for the search term at the relevant time.

  9. Search results displayed under the "Sponsored Links" or "Adwords" sections of the Google website or search results displayed on the website of a country specific host of Google, eg. www.google.com.au, shall be disregarded and are ineligible to enter the Competitions.

  10. The winners of the SEO Player Competition and the SEO Stayer Competition shall be judged by the owner of SearchGuild.com (or their designated moderator). The judges' decision shall be final and no correspondence will be entered into.

  11. The winners of the SEO Player Competition and the SEO Stayer Competition will be notified by email using the address listed with SearchGuild.com for the relevant forum member. Any incorrect or invalid contact details for the Entrant shall render the entry invalid.

  12. The winner of the SEO Player Competition will receive a mini iPod ™ valued at US$200.00. The winner of the SEO Player Competition will receive a flatscreen monitor valued at US$600.00. Prizes will be packaged and shipped to the winner of each competition within 72 hours of the winner being notified.

  13. The abovementioned prizes, including any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash. No responsibility is accepted for any variation in the value of the prizes. The Promoters reserve the right to replace the prizes with items of similar specifications and/or equal value.

  14. Any costs associated with accessing the Promoter's website(s) and/or entering the Competitions shall be the Entrant's sole responsibility.

  15. The Promoters shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) of for personal injury which is suffered or sustained, as a result of taking any of the prizes, except for any liability which cannot be excluded by law.

  16. The Promoters are not responsible for any incorrect or inaccurate information, ether caused by website users or by any of the equipment or programming associated with or utilised in the Competitions, or by any technical error that may occur in the course of the administration of the Competitions. The Promoters assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.

  17. The Promoters may be required to collect the Entrants' personal information in order to conduct the Competitions. The Promoters will not collect any personal information for further promotional, marketing or publicity activities. The only personal information that is compulsory are the details required for membership into SearchGuild.com. The only personal information that will be used by The Promoters is contact details to send the winner their prize.

The winner shall be responsible for any taxes and duty payable on the Prize upon delivery into their country, state or territory
